IT IS STIPULATED AND AGREED, by and between plaintiffs listed in the foregoing caption and the Wyeth Defendants, through their respective undersigned counsel, that any and all proceedings related to Wyeth’s Motion to Enforce Pretrial Order No. 1415 as to class members Bonnie Adams, et al. (the “Motion”), including, without limitation, the filing of Wyeth’s Reply Brief in Support of the Motion is directed have indicated that they are interested in engaging in negotiations with Wyeth via a Proposed Settlement Process.

In order to facilitate the possible resolution of these claims, the parties, through their respective undersigned counsel, have agreed to a Stay of any and all proceedings in civil actions filed in state courts by the plaintiffs listed in the foregoing caption so that the parties may avoid the time and expense of ongoing litigation in numerous individual lawsuits. A stay of proceedings related to Wyeth’s Motion is necessary to effectuate the overall stay of these plaintiffs’ individual civil actions and to facilitate the possible resolution of these claims. The intent and purpose of this Stipulation is to preserve the rights of the parties with respect to Wyeth’s Motion during settlement negotiations. Nothing in this Stipulation shall be construed as a waiver of plaintiffs’ position that the Motion was not timely filed.

The initial stay shall be for a period of 30 days. If, prior to the expiration of the 30 day period, the parties to this Stipulation notify the Court that the Settlement Process is proceeding and negotiations are continuing, then such Stay related to the Motion shall be extended for a period up to 6 additional months.

If either party to the Stay notifies this Court that additional time is needed, the Court may, for good cause shown, extend the stay related to the Motion for a period the Court deems appropriate. NOW, THEREFORE, this 30^th day of March, 2005, upon consideration of the Motion of the AHP Settlement Trust to Pay Claims Designated As Payable By Wyeth Pursuant To Pretrial Order No. 3882 (the AMotion@), the two supplements to the Motion, and any response thereto, it is hereby ORDERED AND DECREED that the Motion, as supplemented, is GRANTED. The Trust shall pay those claims designated as Payable by Wyeth on Schedule 1 attached hereto, at the benefit levels and in the amounts determined by Wyeth as set forth therein in accordance with Pretrial Order 3882. Payment under this Order is subject to the resolution of any outstanding subrogation claims pursuant to the terms of the Settlement Agreement.
